Terms of Service

By accessing or using the CRM CRM platform (“Service”) operated by CRM (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access the Service. By creating an account, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.

CRM is a cloud-based customer relationship management (CRM) platform that provides tools for contact management, email campaigns, SMS messaging, power dialing, support ticketing, deal pipeline management, and related business productivity features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate or incomplete.

You must notify us immediately of any unauthorized use of your account at support@example.com.

Certain features of the Service require payment. You agree to pay all fees associated with the plan you select. Fees are billed in advance on a monthly or annual basis and are non-refundable except as set forth in our refund policy.

We use Stripe to process payments. By providing payment information, you authorize us to charge your payment method for all fees incurred. Prices are subject to change with 30 days written notice.

Failure to pay fees may result in suspension or termination of your account. All overdue amounts will accrue interest at the rate of 1.5% per month.

You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. No partial refunds will be issued for unused time in the current billing period, except as provided in our 30-day refund policy.

We reserve the right to terminate or suspend your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or violate applicable laws. Upon termination, your right to use the Service will cease immediately and your data may be deleted after a 30-day retention period.

The Service and its original content, features, and functionality are and will remain the exclusive property of CRM and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights to the data and content you upload to the Service (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing the Service to you.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CRM

To the maximum extent permitted by applicable law, CRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

In no event shall our aggregate liability exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100 if you have not made any payments.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so the above limitations may not apply to you.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida. You hereby consent to personal jurisdiction in those courts.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

We reserve the right to update or modify these Terms at any time. We will provide at least 30 days notice of material changes by email or through a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
